Welcome to Kavast. By using our application, you agree to these Terms of Service. Please read them carefully.

1. Use of the Service

Kavast provides tools for coffee cupping, data logging, and professional networking. You must be at least 13 years old to use the application. You are responsible for maintaining the security of your account.

2. User-Generated Content

You retain ownership of the data and content you create in Kavast. By publishing content to the Directory, you grant us a worldwide, non-exclusive license to host and display that content to other users of the app.

You agree not to post content that is:

• Illegal, offensive, or abusive.
• Infringes on intellectual property rights.
• Contains viruses or malicious code.
• Unrelated to the professional nature of the application.

2A. Use of Non-Personal, De-Identified, and Aggregated Data

Notwithstanding Section 2 (User-Generated Content), to the maximum extent permitted by applicable law, you acknowledge and agree that Kavast may collect, use, process, modify, analyze, aggregate, and commercialize information and data generated through your use of the Service that does not identify you personally (“Non-Personal Data”).

For the purposes of these Terms, “Non-Personal Data” includes data that has been anonymized, de-identified, or aggregated such that it cannot reasonably be used to identify an individual, directly or indirectly. This may include, without limitation, data relating to coffee samples, cupping results, sensory attributes, processing methods, brewing parameters, evaluation metrics, usage patterns, and other technical or professional data created within the application.

Non-Personal Data expressly excludes personal data, including but not limited to your name, surname, username, email address, social media identifiers (including Instagram), precise location, or age.

You hereby grant Kavast a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free license to use such Non-Personal Data for any lawful purpose, including but not limited to:

• operating, maintaining, and improving the Service;
• developing new features, products, or services;
• creating analytics, benchmarks, and industry insights;
• generating research, reports, and statistical models;
• producing and commercializing datasets, insights, or derivative products;
• sharing, publishing, or licensing aggregated and/or de-identified data with third parties.

Such use shall apply regardless of your use of optional features, including any settings related to sharing, publishing, or analytics visibility, provided that the data used does not identify you as an individual.

Kavast will implement reasonable technical and organizational measures designed to ensure that Non-Personal Data cannot be re-identified or linked back to any individual.

Notwithstanding the foregoing, Kavast retains the rights outlined in Section 2A with respect to Non-Personal Data.

3. Subscriptions and Payments

Kavast offers free and paid tiers. Paid subscriptions (Pro and Expert) are managed through the Apple App Store, Google Play Store, or our website.

• App Store Purchases: Billing and refunds are handled exclusively by Apple or Google. Please refer to their respective terms.
• Web Purchases: Payments are processed via Stripe. Refund requests for web purchases will be evaluated on a case-by-case basis and can be requested by contacting lev@kavast.app.
• Cancellations: You can cancel your subscription at any time through your device settings or account portal.

4. Limitation of Liability

Kavast is provided "as is" without warranties of any kind. We are not liable for any loss of data or business interruptions resulting from the use of the application.

5. Termination

We reserve the right to suspend or terminate your account if you violate these terms or engage in illegal activity within the app.

6. Changes to Terms

We may update these terms from time to time. We will notify you of significant changes via email or an in-app notification.
